RESO 2021-22 AMEND DECLARATION OF STATE OF EMERGENCY MARCH 14, 2020, AT 1:00 P.M. AND SHALL REMAIN IN EFFECT UNTIL 8:00 P.M. ON MAY 24, 2021, UNLESS SUPERSEDED SOONER; AMENDING RESOLUTION NO. 2021-21 COVID-19 (CORONAVIRUS DISEASE) The proposed ordinance is petitioning to vacate the alley located between 1208 and 1222 Birch Street; Applicant: Michael Moore and Panvadee Moore; File No. 311-21-000011- PLNG. Pohl presented a PowerPoint presentation showing an aerial description of the alleyway proposed to be vacated and the applicable standards for proceedings to be initiated pursuant to ORS 271.120, noting the alley is a 16-foot wide dead-end rightof-way. The alley was platted as part of the Knob Hill Addition in 1909 and has been partially improved to provide vehicular access to abutting properties. The abutting property owners have petitioned to vacate the alleyway. All relevant utility companies were notified and no objections were received. The City has no reservations, conditions or easements over the vacated area appearing to be necessary and in the public interest. There is no ownership of land or consideration of any payment to the City because it is a dedicated public right-of-way. In conclusion of the above-noted staff report, Pohl advised staff is recommending Council approve the proposed ordinance, as outlined in Exhibit A, noting the vacation criteria has been met pursuant to ORS, as outlined in Exhibit B (Findings). If Council adopts the proposed ordinance after its second reading on May 24, 2021, the ordinance is recorded in the County Deed Records (30-day waiting period after enactment). Before proceeding with Council discussion, Mayor Truax asked for a motion to adopt Ordinance No. 2021-02 for first reading. VanderZanden read Ordinance No. 2021-02 by title for first reading.
